The Supreme Court of the Northern Territory recently handed down a decision that could have major consequences for the Top End’s justice system.

The Court confirmed that Local Court judges have the power to adjourn or stay proceedings where a defendant cannot access legal representation.

In simple terms, if someone cannot obtain a lawyer, their case may not be able to proceed.

“EVERY TERRITORIAN DESERVES A FAIR TRIAL”

From a fairness perspective, this is the right decision.

Every Territorian deserves a fair trial.

Access to legal representation is a fundamental part of our justice system, and no one should be forced through complex legal proceedings without adequate support.

But this ruling highlights a problem that has been building for months.

MANY TERRITORIANS FORCED TO REPRESENT THEMSELVES IN COURT

Back in November, Legal Aid NT announced significant restrictions to its services because of funding pressures.

Since then, many Territorians who would normally qualify for assistance have been left to represent themselves in court.

In some cases, this has included children.

NO FUNDING FOR LEGAL AID IN NT BUDGET

For the past six months, we have been raising concerns about this issue and calling on the Northern Territory Government to properly fund Legal Aid NT.

Like many others, I hoped the 2026-27 Budget would finally address the problem.

Unfortunately, that did not happen.

I recently received direct confirmation from Catherine Voumard, Director of the Northern Territory Legal Aid Commission, that the latest Budget provides no additional funding for Legal Aid NT.

CASES MAY BE ADJOURNED INDEFINITELY

That leaves us where we are today.

The Supreme Court has rightly protected the principle of a fair trial, but unless the Government acts, the practical result could be significant delays across the court system.

Cases may be adjourned indefinitely because defendants simply cannot access legal representation.

Justice delayed is justice denied.

“NT GOVERNMENT NEEDS TO FUND LEGAL AID”

The NT Government can no longer ignore this issue.

The solution is clear.

Legal Aid NT needs adequate funding so Territorians can access legal representation and courts can continue to operate effectively.

The ball is now firmly in the Government’s court.

Attorney-General Marie-Clare Boothby and the Northern Territory Government have the power to resolve this issue.

Until they do, Territorians, victims, defendants, and the broader justice system will continue to bear the consequences.
