In a landmark verdict, a New York jury has awarded A$3 million to a 22-year-old woman who sued her former psychologist and plastic surgeon for malpractice over a double mastectomy she received at 16 while seeking to transition to a male.

The trial marked the first time a detransitioner’s malpractice case has gone before a jury and ended in a financial judgment.

Jurors found both the psychologist and the surgeon liable for failing to meet the standard of care in treating Fox Varian who identified as transgender at the time of the surgery, but later detransitioned and no longer does.

They awarded Ms. Varian A$2.4 million for past and future pain and suffering and A$600,000 for future medical expenses.

JURY FINDS PSYCHOLOGIST, SURGEON DID NOT FOLLOW ADEQUATE PROTOCOLS

The jury determined the providers did not follow adequate protocols, including thorough communication and evaluation prior to performing surgery, and concluded these failures constituted a “departure from the standard of care.”

Defence attorneys representing Ms. Varian said the psyhologist “drove the train” in his counseling of the then-teenager, accusing him of “putting the idea in Fox’s head” that she needed to address her apparent gender dysphoria by permanently changing her body through a double mastectomy.

Claire Deacon, the patient’s mother, said during the trial she was opposed to the surgery, but ultimately gave in, fearing her daughter would commit suicide without the irreversible procedure — a frequent refrain of those who advocate for transgender procedures.

“This man was just so emphatic, and pushing and pushing, that I felt like there was no good decision,” Ms. Deacon testified.

“I think it was a scare tactic. I don’t believe it was malice. I think he believed what he was saying — but he was very, very wrong.”

JURY SUPPORTS CLAIM OF MEDICAL NEGLIGENCE

The defendants argued that their clinical decisions followed existing guidelines and that the teenager had expressed a strong desire to transition and made self-harm threats which were not instigated by her therapist.

The jury ultimately disagreed with their arguments, siding with Ms. Varian on the claim of medical negligence.

The lawsuit did not question the general legality or medical appropriateness of gender-transition treatments for minors, but rather asserted that in this case, they were provided without sufficient scrutiny or coordination.

TRIAL IGNORED BY NEARLY ALL AMERICAN MEDIA

Despite the potential for the landmark ruling, the trial was ignored by the mainstream US media with only two reporters present during proceedings.

Journalist Benjamin Ryan who attended the full trial, stated that his detailed notes may be the only comprehensive public record of the event.

He described the three-week trial as “riveting and at times devastating.”

“Since the entire case is sealed, including all the trial transcripts, the product of my furious note-taking during the proceedings may be the only way for the public to learn about the finer details of this lawsuit.”

CASE COULD OPEN THE FLOODGATES FOR MORE LAWSUITS

The case sets a precedent for other detransitioners seeking legal remedies.

Ryan wrote that 28 detransitioner lawsuits have been filed in the United States to date, but some have hit legal roadblocks.

“Quite a few of them have run up against strict statutes of limitation, such as the case against leading pediatric gender doctor Johanna Olson-Kennedy,” Ryan wrote.

Christian activist Robby Starbuck who directed the documentary on the subject called The War on Children, predicted “the floodgates will open as more go to trial.”

“What was done to these kids is a crime against humanity.”

“An unforgivable evil that must be extinguished from the earth. Never again.”

“The damage these kids carry is heartbreaking,” he said.

NEW HOPE FOR ANOTHER DETRANSITIONER

Prisha Moseley, another detransitioner who’s suing the medical personnel who pushed and performed transgender-affirming surgeries on her when she was a minor, responded  to the verdict: “May justice prevail!”

She has previously told CBN News that the medical support she received was “a lie and a scam.” 

She said doctors gave her “false hope” that undergoing transgender-affirming surgeries would drastically improve her life.

VERDICT COMES AMID ONGOING DEBATE OVER TREATING GENDER DYSPHORIA

The Christian Post reports the Varian ruling comes amid ongoing debates over medical interventions for gender dysphoria in minors and scrutiny of the practices followed by clinicians providing these treatments.

Doctors have faced criticism for proceeding with irreversible interventions without comprehensive psychological evaluation or interdisciplinary oversight.

More than two dozen US states have enacted policies banning the provision of body-mutilating sex-change surgeries and hormone drugs to minors.

EUROPEAN NATIONS REEVALUATE THEIR APPROACHES

In recent years, European medical bodies, such as those in the United Kingdom, Sweden, and Norway, have reevaluated their approaches to treating children with gender dysphoria.

In  2024, the UK’s National Health Service (NHS) instructed gender clinics to pause first appointments for kids under 18 following the formal review led by Dr. Hilary Cass, the retired former president of the Royal College of Paediatrics and Child Health.

Cass’s report found there is “no good evidence on the long-term outcomes of interventions to manage gender-related distress.”
